The Processor is prohibited from:
- The sharing or selling or personal information.
- Retaining, using, or disclosing personal information for any purpose other than the purpose of performing the services specified in the contract or outside of the direct business relationship between the parties, including for Processor’s commercial
- Combining the personal information with any personal information the Vendor receives from another entity or collects on its own
Privacy of Children
Cerama Bryte encourages parents and guardians to be aware of and participate in their children’s online activities. We strictly adhere to the Children’s Online Privacy Protection Act and will not knowingly collect, use or disclose Personal Information from any child under the age of 13 in any manner that violates this law.
COMPLAINCE WITH PRIVACY RIGHTS
To the extent required by law, Cerama Bryte will assist the controller in fulfilling consumer rights request and provide information necessary to conduct privacy assessments. Cerama Bryte is obligated to ensure that each person processing personal information is subject to confidentiality. We will cooperate with reasonable audits (CO) or assessments (CT/VA) or conduct independent assessment to the Controller upon request. The Controller is permitted to take appropriate action is the event of information misuse or breach of contract. Upon request or termination of agreement, we will return or delete all personal information, unless otherwise required by law. We will make available all material to demonstrate compliance at the request of Controller. The controller is granted the right to take reasonable and appropriate steps to ensure the Processor is using personal information in compliance with the law. In the event of use of a subprocessor, the processor is required to notify the Controller. In the event of use of a subprocessor, a written agreement must be entered into that requires processor to meet privacy obligations.
SECURITY AND DATA BREACHES
The Processor is required to implement and maintain reasonable security procedures and practices appropriate to the nature of the information, to protect the personal information from unauthorized access, destruction, use, modification, or disclosure. Processor must notify Controller if Processor suspects unauthorized access or misuse of personal information and assist Controller in its compliance with data breach notification obligations. For de-identified data, the agreement must require the Processor to take reasonable measures to ensure that the data cannot be associated with a natural person, publicly commit to maintaining and using de-identified data without attempting to re-identify the data, and contractually obligate any recipients of the de-identified data to do the same. For de-identified and/or pseudonymous data, the agreement must allow the Controller to take appropriate actions to monitor compliance with contractual obligations related to the data and take appropriate steps to address any breaches of those commitments.
Your Opportunity to Opt-out of Email Advertising
In the event you do not wish to receive promotional email from Cerama Bryte, follow the opt-out instructions contained within the body of any email message you receive.
